Rules for buying and selling goods in Gėlių sala online store

      Concepts

1.1. Seller - Private legal entity UAB "Gėlių sala", legal entity code 159978373, VAT taxpayer code LT599783716, registered office address Žilvičių st. 16a, Teleičiu village, Kaunas district LT-53273 Lithuania.

1.2. Buyer - 1) Individual, i.e. a person who has reached the age of majority, whose capacity is not limited by court order; 2) A minor between the ages of fourteen and eighteen who has the consent of his parents or guardians, except in cases where he disposes of his own income; 3) Legal entity; 4) A legal entity or an authorized representative of the listed persons.

1.3. Rules – Purchase and sale rules that determine mutual relations, rights, duties and responsibilities between the Buyer and the Seller.

1.4. Contract - During the purchase and sale, a contract is concluded between the Buyer and the Seller.

1.5. E-shop - The Seller's website/shop www.floristika.lt, which is used to identify the Buyer, his order, contact details, payment and delivery details;

1.6. Pickup store - Žilvičių st. 16a, Teleičiu village Kaunas district LT-53273 Lithuania,

1.7. The mobile manager is an employee of UAB "Gėlių sala" who delivers the goods to the address specified by the buyer.

 

2. General provisions

2.1. These purchase and sale rules determine the mutual rights, duties and responsibilities of the person purchasing goods in the www.floristika.lt electronic store and UAB "Gėlių sala", when the Buyer purchases goods in the electronic store. By purchasing goods in the online store, the Buyer agrees to the application of these Rules.

2.2 The contract is considered signed when the Buyer approves the Rules after familiarizing himself with them and ticks the box next to the statement "I have read the rules for buying and selling goods in the online store www.floristika.lt and I agree with them".

 

3. Seller's Rights

3.1. If the Buyer tries to harm the work or stable operation of the electronic store or violates his obligations, the Seller may limit, suspend (terminate) his access to the electronic store without prior warning and is not responsible for any related losses of the Buyer.

3.2. The Seller has the right to temporarily or indefinitely terminate the operation of the electronic store without separate notice and is not responsible for any related losses of the Buyer.

3.3. The seller has the right to unilaterally change these Rules by publishing the changed Rules on the website of the electronic store. Changes take effect from the moment of publication for all transactions concluded after publication.

3.4. The seller has other rights provided for in the Rules and legal acts of the Republic of Lithuania.

3.5. The Seller has the right to cancel the Buyer's order without prior warning, if the Buyer, having chosen the payment methods provided in the clauses, does not pay for the goods within 2 (two) working days.

3.6. When the Buyer chooses the payment method provided for in the Rules (7.3), the Seller, in the event of uncertainty regarding the information provided in the order, has the right to contact the Buyer using the contacts specified in the order. In this case, the term of delivery of the goods starts counting from the day of contact with the Buyer. The Seller has the right to cancel the Buyer's order without prior notice:

1) If the Seller fails to contact the Buyer within 2 (two) working days after placing the order

2) If the Buyer does not provide the Seller with the requested information within the deadline specified by the Seller

3) If the Buyer does not give the Seller consent to check his personal data.

 

4. Obligations of the seller

4.1. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the electronic store.

4.2. The seller guarantees the quality of the product.

4.3. The seller undertakes to provide sufficiently accurate product characteristics, which are necessary to evaluate the product.

4.4. The Seller, in the event of important circumstances, being unable to deliver the ordered goods to the Buyer, undertakes to return the money paid by the Buyer within 10 working days. In this case, the Seller is released from responsibility for non-delivery of the goods.

4.5. The seller undertakes to comply with other requirements set forth in these Rules.

 

5. Buyer's rights

5.1. The buyer has the right to buy goods in the electronic store in accordance with these Rules and the legal acts of the Republic of Lithuania.

 

6. Obligations of the buyer

6.1. The Buyer must pay for the ordered goods, delivery of the goods and accept them in accordance with the procedure established by these Rules.

6.2. The Buyer undertakes not to transfer his login data to third parties. And if you lose your login data, you must immediately inform the Seller about it.

6.3. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.

6.4. The Buyer, using online store, undertakes to comply with these Rules and other conditions provided by online store and the legal acts of the Republic of Lithuania.

 

7. Ordering goods, prices, payment procedure, deadlines. 

7.1. In the online store, the Buyer can place an order online 7 days a week, 24 hours a day.

7.2. Product prices in an online store are indicated in euros, including the amount of VAT valid at that time according to the legislation.

7.3. The Buyer can pay for the ordered goods in the following ways:

       1. By bank transfer;

       2. In cash when picking up the goods;

7.4. Delivery term of the goods begins to be calculated after the payment of the invoice in the selected method.

7.5. The Buyer undertakes to pay for the order within 2 (two) calendar days from the day of order confirmation. The package starts to be prepared only after receiving the payment for the goods.

7.6. If the buyer does not make the payment within 2 calendar days, the order is cancelled.

7.7. By approving the rules, the Buyer agrees that the documents for the purchase of goods - VAT invoices and other documents submitted for approval by legal acts regulating accounting should be submitted electronically.

 

8. Delivery and collection

8.1. The Buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods.

8.2. The Buyer can choose different delivery methods:

      1. Delivery by courier

      2. The goods can be picked up at the Seller's warehouse (Žilvičių st. 16a, Teleičių village, Kaunas district)

8.3. The goods are delivered on the territory of Lithuania within 5 (five) working days from the receipt of payment.

8.4. When the Buyer wishes the goods to be delivered outside of Lithuania, the delivery conditions of the order are negotiated in a separate agreement.

8.5. The terms of delivery of goods are valid if the Seller has the ordered goods in stock. If, due to unforeseen circumstances, the Seller is unable to deliver the goods within the period specified in point 8.3, the Seller undertakes to inform the Buyer immediately.

8.6. The Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties or due to circumstances beyond the control of the Buyer.

 

 Returns and warranty

1.1   The return of goods takes place in accordance with the laws of the Republic of Lithuania.

1.2 The Buyer has the right to return the goods by notifying the Seller in writing or by phone no later than 14 working days from the day of delivery of the goods. The Buyer must specify the product code specified in the invoice and the invoice number or other document proving the purchase of the product.

1.3 The returned product must be

· Fully assembled

· Packaged in the same way as at the time of delivery

· Undamaged and unused by the buyer (untorn labels, undamaged packaging)

1.4 If the Buyer does not comply with the requirements specified in point 1.3, the Seller reserves the right not to accept the goods and not to return the money paid.

1.5 If the product is returned not due to quality discrepancies, all return (shipping, courier, transportation) costs must be covered by the Buyer.

9. Protection of personal data

9.1 When submitting an order to the Seller, the Buyer must provide personal data that the Seller can use to identify the Buyer, deliver the order, contact if additional information is needed or use them for direct marketing purposes.

9.2 The Buyer is responsible for the correct submission of data during registration.

9.3. By placing an order, the Buyer agrees to send informational messages to the e-mail address and phone number indicated by him, which are necessary to fulfill the order for goods.

9.4 The Buyer, who does not want his e-mail address or telephone number to be used for direct marketing purposes, must notify the Seller.

9.5. The Seller confirms that the personal data specified by the Buyer will be processed only for the purpose of purchasing goods from the Seller and direct marketing (except for cases where the Buyer notifies, in accordance with the procedure specified in Clause 9.4 of the Rules, that he does not wish his personal data to be processed for the purposes of direct marketing). The Seller undertakes not to disclose the Buyer's personal data to third parties, with the exception of the Seller's partners providing goods delivery or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided by the legislation of the Republic of Lithuania.

9.6. The Buyer, registering in online store and ordering goods, undertakes to protect and not disclose login data to anyone.

 

10. EGS Platform

Electronic resolution of consumer disputes in accordance with European Parliament and Council Regulation (EU) No. 524/2013.

Disputes related to the contractual obligations established in electronic purchase and sale or service contracts between a consumer habitually resident in the European Union and a commercial activity entity established in the European Union can be filed through the Electronic Dispute Resolution (EGS) platform.

The EGS platform is a simple, efficient, fast, impartial, transparent, inexpensive way to resolve disputes arising from electronic transactions outside of court.

11. Final Provisions

11.1. All disagreements arising from or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved by negotiation. If it is not possible to reach an agreement, disagreements are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
